NETTRACKS – TERMS OF SERVICE

1. Acceptance of Terms
By using NetTracks services or accessing our website, you agree to these Terms of Service. If you do not agree, do not use our services.
2. Services Provided
NetTracks provides:
• Website design and development
• Hosting and maintenance
• Consulting and digital strategy
All services are provided on a best-effort basis with the goal of delivering reliable, professional results.
3. Client Responsibilities
You agree to:
• Provide accurate content, images, and information
• Respond promptly to requests and approvals
• Review work and provide feedback in a timely manner
• Maintain your own copies of submitted materials
Project delays caused by lack of response may impact timelines and delivery.
4. Payments and Fees
• A deposit (typically 50 percent) is required before work begins
• Final payment is due prior to website launch or delivery
• Hosting and ongoing services are billed monthly or annually
Failure to pay may delay or stop work.
5. Refunds and Cancellations
• Deposits are non-refundable once work has begun
• If a project is canceled, completed work will be billed
• No refunds are provided for completed work or delivered services
6. Hosting and Service Continuity
• Hosting requires active payment to remain live
• Non-payment may result in suspension or removal of the website
• Data may be deleted after a reasonable period of non-payment
• Clients are responsible for maintaining backups if requested
7. Third-Party Services
NetTracks may use or recommend third-party services including:
• Hosting providers
• Payment processors
• Plugins and software tools
We are not responsible for outages, failures, or policy changes from these providers.
8. Limitation of Liability
To the fullest extent permitted by law:
• NetTracks is not liable for indirect or consequential damages
• Total liability is limited to the amount paid for the service
• We do not guarantee uninterrupted or error-free operation
9. Intellectual Property
• Final website ownership transfers to the client after full payment
• NetTracks retains the right to display completed work in portfolios
• Third-party assets remain subject to their original licenses
10. Termination
We reserve the right to terminate services for:
• Non-payment
• Misuse of services
• Abusive or unlawful behavior
All outstanding balances remain due upon termination.
11. Communication
We aim to respond promptly, typically within 24 to 48 hours during business days.
12. Governing Law
These terms are governed by the laws of the United States and applicable state law.
